Justice Ginsberg was wrong after all


Back in May I wrote about how Justice Ginsberg wasn't necessarily stupid, she was just a liberal.


She claimed that the SCOTUS needed another women, citing an example of a 13 year old who was strip searched in school, saying the male majority couldn't sympathize with being a 13 year old girl. Any one can sympathize with the girl, but not everyone can empathize with her, not having been teenage girls who were strip searched.


I said then, and still maintain, empathy and sympathy are great to have, but are irrelevant to performing one's job on the SCOTUS. The limited constitutional powers reserved the Supreme Court is to determine whether statutes, laws and lower court rulings were made consistent with the constitution. A Supreme Court justice ideally should make all decisions without emotion, passion, or prejudice and use the constitution as the final arbiter of right and wrong. Because for good or bad, that is the constitutional power granted the court.


Of course since 1805 the SCOTUS has been making law instead of simply determining it's constitutionality... but that is irrelevant. Justice Ginsberg is a liberal, judicial activist who sees her role as determining law and policy.


Justice Ginsberg was also proven wrong, there is no need for another female justice (based upon her limit reasoning) as the court ruled 8 -1 that the strip search of a 13 year old girl by school officials was unconstitutional.


You see there was no need for the other (male) justices to know what it is like for a 13 year old girl to be strip searched at that "funny age". They understood that school officials on an unsubstantiated search for drugs do not have the right to strip search their charges, regardless of gender or age.


And that is what is important. This case was not about the age or gender of the person in question, it was about the constitutionality of a school authority to mandate a student disrobe while searching for drugs. The ability to empathize with the victim was not important, or even relevant.


As for the dissenting justice I think he really missed the point.


Had the school believed this girl had drugs, even if it was prescription strength Advil, the proper response as part of a zero tolerance policy would have been to call the girl's parents to come get her or call the police.


School officials are not law enforcement officials. If a student is suspected of a crime they should be treated as suspected criminals.

Fact No. 1: Americans have better survival rates than Europeans for common cancers.[1] Breast cancer mortality is 52 percent higher in Germany than in the United States, and 88 percent higher in the United Kingdom. Prostate cancer mortality is 604 percent higher in the U.K. and 457 percent higher in Norway. The mortality rate for colorectal cancer among British men and women is about 40 percent higher.

Fact No. 2: Americans have lower cancer mortality rates than Canadians.
[2] Breast cancer mortality is 9 percent higher, prostate cancer is 184 percent higher and colon cancer mortality among men is about 10 percent higher than in the United States.

Fact No. 3: Americans have better access to treatment for chronic diseases than patients in other developed countries.
[3] Some 56 percent of Americans who could benefit are taking statins, which reduce cholesterol and protect against heart disease. By comparison, of those patients who could benefit from these drugs, only 36 percent of the Dutch, 29 percent of the Swiss, 26 percent of Germans, 23 percent of Britons and 17 percent of Italians receive them.

Fact No. 4: Americans have better access to preventive cancer screening than Canadians.

  • Nine of 10 middle-aged American women (89 percent) have had a mammogram, compared to less than three-fourths of Canadians (72 percent).

  • Nearly all American women (96 percent) have had a pap smear, compared to less than 90 percent of Canadians.

  • More than half of American men (54 percent) have had a PSA test, compared to less than 1 in 6 Canadians (16 percent).

  • Nearly one-third of Americans (30 percent) have had a colonoscopy, compared with less than 1 in 20 Canadians (5 percent).

Fact No. 5: Lower income Americans are in better health than comparable Canadians. Twice as many American seniors with below-median incomes self-report "excellent" health compared to Canadian seniors (11.7 percent versus 5.8 percent). Conversely, white Canadian young adults with below-median incomes are 20 percent more likely than lower income Americans to describe their health as "fair or poor."[5]

Fact No. 6: Americans spend less time waiting for care than patients in Canada and the U.K. Canadian and British patients wait about twice as long - sometimes more than a year - to see a specialist, to have elective surgery like hip replacements or to get radiation treatment for cancer.[6] All told, 827,429 people are waiting for some type of procedure in Canada.[7] In England, nearly 1.8 million people are waiting for a hospital admission or outpatient treatment.[8]

Fact No. 7: People in countries with more government control of health care are highly dissatisfied and believe reform is needed. More than 70 percent of German, Canadian, Australian, New Zealand and British adults say their health system needs either "fundamental change" or "complete rebuilding."[9]

Fact No. 8: Americans are more satisfied with the care they receive than Canadians. When asked about their own health care instead of the "health care system," more than half of Americans (51.3 percent) are very satisfied with their health care services, compared to only 41.5 percent of Canadians; a lower proportion of Americans are dissatisfied (6.8 percent) than Canadians (8.5 percent).

Fact No. 9: Americans have much better access to important new technologies like medical imaging than patients in Canada or the U.K. Maligned as a waste by economists and policymakers naïve to actual medical practice, an overwhelming majority of leading American physicians identified computerized tomography (CT) and magnetic resonance imaging (MRI) as the most important medical innovations for improving patient care during the previous decade.[11] [See the table.] The United States has 34 CT scanners per million Americans, compared to 12 in Canada and eight in Britain. The United States has nearly 27 MRI machines per million compared to about 6 per million in Canada and Britain.[12]

Fact No. 10: Americans are responsible for the vast majority of all health care innovations.
[13] The top five U.S. hospitals conduct more clinical trials than all the hospitals in any other single developed country.[14] Since the mid-1970s, the Nobel Prize in medicine or physiology has gone to American residents more often than recipients from all other countries combined.[15] In only five of the past 34 years did a scientist living in America not win or share in the prize. Most important recent medical innovations were developed in the United States.[16] [See the table.]


Conclusion. Despite serious challenges, such as escalating costs and the uninsured, the U.S. health care system compares favorably to those in other developed countries.

However, the government is not in control. There is not an omnicient, omnipotent government agency doling out medical services so the leftards won't rest until the gold standard of medical science is reduced to the level of England and Canada where people come to the US for care.

Universal healthcare will not be cheap but the point that cannot be overlooked is that the most expensive cost of the program will be the rationing. During the ABC Obamacare informercial a lady told the story of her 85 year old mother who was denied a pacemaker by medicare and several doctors, eventually they found a doctor who said she had such a "healthy spirit" she woudl eb a good risk for a pace maker and installed it. Obama's response was "we need a more scientific reason that a spirit to determine healthcare."

Since Obama is determined to hitch the nation's economic health to bullshit called global warming, we can be assured he doesn't care one iota about science.

Obamacare is about government control and the corresponding lack of personal freedom.

As an aside... I would be remiss at pointing out that Resident Obama, MD had only 4.7 million viewers... nearly half of those watching the CSI repeat on CBS. And the cable news programs maintained similar numbers to their nightly counts, so not even the Obamatrons staring mouthes agape at Olbermann, Cooper or Grace changed tuned in to Obama. And Obama had a 7.3 million viewer lead in to his infomercial. Too bad he didn't get Billy Mays to pitch it for him.

The Wedding Test

THE WEDDING TEST

I was a very happy man. My wonderful Girlfriend and I had been dating for over a year, and so we decided to get married. There was only one little thing bothering me..It was her beautiful younger sister.

My prospective sister-in-law was twenty-two, wore very tight miniskirts, and generally was bra-less. She would regularly bend down when she was near me, and I always got more than a nice view. It had to be deliberate. Because she never did it when she was near anyone else.

One day her "little" sister called and asked me to come over to check the wedding invitations. She was alone when I arrived, and she whispered to me that she had feelings and desires for me that she couldn’t overcome. She told me that she wanted me just once before I got married and committed my life to her sister. Well, I was in total shock, and couldn’t say a word. She said, "I’m going upstairs to my bedroom, and if you want one last wild fling, just come up and get me." I was stunned and frozen in shock as I watched her go up the stairs. I stood there for a moment, then turned and made a beeline straight to the front door. I opened the door, and headed straight towards my car.

Lo and behold, my entire future family was standing outside, all clapping! With tears in his eyes, my father-in-law hugged me and said, "We are very happy that you have passed our little test. We couldn’t ask for a better man for our daughter. Welcome to the family."

The moral of this story is: Always keep your condoms in your car!

This is a blog I've been kicking around for some time inspired by the events that took place in the run up to the 2008 Presidential election... but my desire to finish it was based in part by a friend who claimed that Sarah Palin was the reason McCain lost.

Now I was unable to finish that conversation, but I disagreed with that premise.

Many of my online friends will remember I was advocating a Thompson/Palin ticket as early as January 2008. I thought that their qualities, a conservative, grandfatherly experienced Beltway politician who was not a DC insider, and a young, conservative Beltway outsider, but with political experience was what our country needed.

A common sense pair with Palin being the youthful energy willing to challenge the staus quo and Thompson having the chops to tell the Old Guard to let her have at it.

However, Thompson never got in the race and the MSM coronation of McCain as the RNC candidate just as the DNC picked Obama to be their candidate.

When McCain chose Palin to be his VP candidate it was the most exciting thing to invigorate a campaign destined to fail. McCain v. Obama was destined to be a one sided battle with the senior Senator from Arizona being the one led to slaughter.

While die hard Republicans got behind McCain that is a no-brainer... they would have gotten behind anyone that won the nomination. But conservatives we not so enthused with the thought of another right leaning moderate in the White House, especially one like McCain who was a member of the Gang of 14 and instrumental in the McCain - Feingold debacle and the McCain - Kennedy amnesty fiasco.

Likewise much of the "independent" support for McCain was split straight down party lines with hard left and left leaning indies trending towards Obama and right leaners trending to McCain with hard right indies and moderates having no preference.

Sarah Palin got the party started.

She was energetic, enthusiastic and genuine.

An unabashed pro-life woman.

So the media marked her for death.

The media went absolutely nuts and went running to Alaska to learn the "real" Sarah Palin. Of course the first story to emerge was that her newborn baby was really her daughter's child and Sarah was merely posing as the mother to cover for her 17 year old daughter's indrescetion.

And through this media generated lie young Bristol was outed as being pregnant... in the national media.

And when the media can stoop so low as to begin their research into someone they didn't know, solely because of their ignorance, they is no basement to how low they will proceed to dip... and they didn't disappoint, the MSM set new standards of despicable behavior in the treatment of Sarah Palin... a disgrace that continues to this day.

But out of the ashes of this event we have realized an incredible truth:

The media is so in the tank for Democrats that they will lie, steal, and spread propaganda as truth, in order to take down anyone who opposes their (liberal Democrat) views. It became so evident in the run up to the 2008 elections that everyone except the most rabid Democrats knows that the MSM is the de facto public relations arm of the DNC.

And you need not look beyond the rating and circulation numbers for the majority of the MSM, in all arenas, to see that their propaganda efforts may have helped them win an election but the cost was their credibility.

So even though she and her family suffered mercilessly at the pens of the MSM, a trend perpetuated to this day across the liberal media enterprise (witness Letterman's lame "joke") she gets the last laugh as the media can no longer be trusted and everyone now can see this, and they continue their inexorable slide toward their twin destinations of bankruptcy and irrelevance.

Of course she can also console herself in the fact that the left continues to attack her because, much as they demonstrated last August, they are afraid of her... which is why the attacks continue.

The Palin family picture prior to the birth of their youngest son. The Lame Stream Media used it as "proof" that it was Bristol who was pregnant at the time... as opposed to Sarah who was "hiding" behind her youngest daughter.
